Legal Chief Specialist, Dubai, UAE

We need a Legal Chief Specialist


اهداف الوظيفة

تقديم الدعم القانوني المتقدم في هيئة تنمية المجتمع من خلال إعداد الدراسات والبحوث القانونية، ومراجعة الأنظمة واللوائح والسياسات، وصياغة العقود والاتفاقيات، وضمان الالتزام القانوني في أنشطة الهيئة، وحصر المخاطر القانونية وضمان الامتثال للوائح والقوانين، ودعم اتخاذ القرار القانوني.


الواجبات والمسؤوليات التشغيلية

1. وضع مبادئ وإجراءات قانونية لتحليل البحوث والدراسات وتنظيمها وفقا ً لأفضل الممارسات والمتابعة مع الباحثين القانونيين لتحليل التائج وإعداد التقارير متضمنة التوصيات.

2. اقتراح تطوير الخدمات الاجتماعية من منظور قانوني، بالتنسيق مع الوحدات التنظيمية المحورية بهدف رفع مقترحات لتطوير التشريعات المتعلقة بالخدمات التي تقدمها الهيئة.

3. إعداد الدراسات القانونية فيما يخص تطبيق التشريعات الجديدة ورصد الأثر ورفع التقارير متضمنة التوصيات والمقترحات القانونية التخصصية.

4. مراجعة السياسات والمنهجيات الداخلية الصادرة من الوحدات التنظيمية المختلفة وضمان التوافق مع القانون والتشريعات ذات العلاقة بالنشاط.

5. صياغة ومراجعة العقود والاتفاقيات الصادرة من وإلى هيئة تنمية المجتمع، وضمان أنها تتماشى مع التشريعات والسياسات والاجراءات الداخلية .

  • اقتراح الحلول القانونية المبتكرة للقضايا والمشكلات ذات العلاقة بالهيئة بما يحقق مصلحتها ويحافظ على التزاماتها وسمعتها الاجتماعية في المجتمع.

  • متابعة قضايا النزاع والمساندة في إجراءات التقاضي أو التحكيم أو الشكاوى، بالتنسيق مع الجهات المختصة وذلك وفقاً للاختصاص ووضع المقترحات لضمان المصلحة القانونية للهيئة والمتعاملين.

  • صياغة مذكرات الرأي القانوني وتقديم الاستشارات القانونية للوحدات التنظيمية المختلفة.

  • متابعة المؤشرات الاستراتيجية والتشغيلية القانونية في الهيئة وتحديد مصادر البيانات ورصد النتائج ومن ثم تحديد الفجوات ورفع التقارير والتوصيات للرئيس المباشر.

  • التعاون مع الجهات الحكومية (محاكم دبي، النيابة العامة وغيرهم) والجهات الخاصة وضمان توفير الاحتياجات القانونية والأدلة والمستندات الداعمة وفقا ًللمتطلبات والقضايا ذات العلاقة بهيئة تنمية المجتمع.

  • تقييم المخاطر القانونية وإعداد التقارير متضمنة الحلول والتوصيات لتقليلها أو معالجتها ورفعها للرئيس المباشر.

12. طرح المقترحات والمبادرات التي تساهم في تطوير وتسهيل الاجراءات القانونية في الهيئة سواءً على مستوى الوحدات التنظيمية والمتعاملين الداخليين أو على مستوى المتعاملين والمستفيدين من خدمات الهيئة.

  • العمل على بناء القدرات القانونية في هيئة تنمية المجتمع، وتقديم ورش عمل للموظفين حول المبادئ القانونية أو التحديثات على التشريعات ذات العلاقة بأنشطة الهيئة والتي تؤثر على العمل بشكل مباشر ونشر الوعي القانوني.

14. تمثيل مكتب الشؤون القانونية في اللجان المشكلة داخل الهيئة كعضو في اللجان أو بناءً على تكليف من مدير المكتب بهدف متابعة الشؤون القانونية المتعلقة بأعمال اللجان أو توفير المشورة القانونية وفقاً للمتطلبات.

15. إدارة قاعدة البيانات القانونية والتأكد من حفظ وأرشفة الدراسات والبحوث والقضايا والأحكام والتشريعات والنصوص القانونية والسجلات القضائية المعنية وتحليل وتفسير المعلومات القانونية واستخدامها في تقديم الدعم القانوني.

  • تمثيل الهيئة أمام الجهات القضائية أو النيابة أو الشرطية ، ومتابعة القضايا بالتنسيق مع الجهات المختصة أو أصحاب المصلحة .

  • اقتراح التعديلات على اللوائح القانونية الداخلية بما يتوافق مع المستجدات على مستوى حكومة دبي وأفضل الممارسات.

  • إعداد التقارير الدورية حول الوضع القانوني لهيئة تنمية المجتمع والقضايا والعقود والمخاطر القانونية والتوصيات وغيرها.

  • المشاركة في إعداد خطة العمل واستراتيجية التشريعات والبحوث السنوية للإدارة والمتابعة .

  • الإلتزام بسياسات وإجراءات أمن المعلومات المعتمدة بالهيئة والعمل على الامتثال بالضوابط لضمان سرية المعلومات.

  • أيه مهام وإختصاصات أخرى في نطاق مسئوليات الوظيفة.


Qualifications


المتطلبات التعليمية

  • بكالوريوس في القانون أو ما يعادله.
  • الأولوية للحاصلين على شهادات عليا (درجة ماجستير أو دكتوراه ذات علاقة).

متطلبات الخبرة

  • 8 سنوات من الخبرة العملية في مجال البحوث والدراسات القاونية.

**Job Objectives**
To provide advanced legal support to the Community Development Authority (CDA) by conducting legal research and studies; reviewing laws, regulations, and policies; drafting contracts and agreements; ensuring legal compliance across the Authority’s activities; identifying legal risks; and supporting legal decision-making processes.


**Operational Duties and Responsibilities**

1.  Establish legal principles and procedures for analyzing and organizing research and studies in accordance with best practices; and coordinate with legal researchers to analyze findings and prepare reports containing recommendations.

2.  Propose enhancements to social services from a legal perspective—in coordination with key organizational units—with the aim of submitting proposals to develop legislation governing the services provided by the Authority.

3.  Conduct legal studies regarding the implementation of new legislation, monitor its impact, and submit reports containing specialized legal recommendations and proposals.

4.  Review internal policies and methodologies issued by various organizational units to ensure their alignment with applicable laws and legislation relevant to the Authority’s activities.

5.  Draft and review contracts and agreements entered into by the Community Development Authority, ensuring their full alignment with relevant legislation, as well as the Authority’s internal policies and procedures.

6.  Propose innovative legal solutions for issues and challenges facing the Authority, thereby safeguarding its interests, upholding its obligations, and preserving its social reputation within the community.

7.  Monitor legal disputes and provide support during litigation, arbitration, or complaint resolution proceedings—in coordination with relevant competent authorities and within the scope of jurisdiction—while formulating proposals to safeguard the legal interests of both the Authority and its stakeholders. Drafting legal opinion memos and providing legal consultations to various organizational units.

Monitoring strategic and operational legal indicators within the Authority; identifying data sources; tracking results; and subsequently identifying gaps, as well as submitting reports and recommendations to the direct supervisor.

Collaborating with government entities (such as Dubai Courts, the Public Prosecution, etc.) and private sector entities, while ensuring the provision of necessary legal support, evidence, and supporting documents in accordance with the requirements and cases relevant to the Community Development Authority.

Assessing legal risks and preparing reports—including proposed solutions and recommendations to mitigate or address them—for submission to the direct supervisor.

12. Proposing suggestions and initiatives aimed at developing and streamlining legal procedures within the Authority, whether at the level of organizational units and internal stakeholders, or at the level of external clients and beneficiaries of the Authority’s services.

Working to build legal capabilities within the Community Development Authority; conducting workshops for employees regarding legal principles or updates to legislation relevant to the Authority’s activities that directly impact operations; and promoting legal awareness.

14. Representing the Legal Affairs Office in committees established within the Authority—either as a committee member or upon delegation by the Office Director—with the aim of overseeing legal matters related to the committees' work or providing legal advice as required.

15. Managing the legal database; ensuring the proper storage and archiving of studies, research, case files, court rulings, legislation, legal texts, and relevant judicial records; and analyzing and interpreting legal information to utilize it in providing legal support.

Representing the Authority before judicial bodies, the Public Prosecution, or police authorities, and following up on legal cases in coordination with the relevant competent authorities or stakeholders. Proposing amendments to internal legal regulations to align with developments at the Dubai Government level and with best practices. 

Preparing periodic reports regarding the legal status of the Community Development Authority (CDA), including updates on legal cases, contracts, legal risks, recommendations, and other relevant matters. 

Contributing to the development of the Department’s annual work plan, legislative strategy, and research initiatives, as well as monitoring their implementation. 

Adhering to the information security policies and procedures approved by the Authority, and ensuring compliance with established controls to safeguard information confidentiality. 

Performing any other duties or responsibilities falling within the scope of the position's mandate.


Qualifications


Educational Requirements

Bachelor’s degree in Law or an equivalent qualification. 
Priority will be given to candidates holding advanced degrees (relevant Master’s or Doctorate degrees).

Experience Requirements

8 years of practical experience in the field of legal research and studies.

Job Summary

As a Compliance Intern, you will serve as a "guardian of standards" within the Risk and Compliance team. Your mission is to ensure the organization stays on the right side of the law and internal rules. You will act as a meticulous observer and researcher, helping to protect the company’s reputation and operational license by identifying risks before they become problems and ensuring that every department follows the established "rulebook."

Description

About Role

The role will be responsible to undertake all daily contracts administration duties with the objective of efficient execution on operational level. Provides professional support service with emphasis on accurate and timely processing of all matters.

Key Responsibilities

  • Provides support in the review and formatting of contracts to cater to administrative needs in line with the document style guidelines and work instructions.
  • Ensure accuracy of Q-CAS and the end-to-end processes are completed as per the objectives set by the management.
  • Provide contracts report in preparation for team meetings and special projects as assigned by the line manager. Provide regular updates to Group Legal upon receipt of contract status, and confirmation of executed contracts in order to track the target opening date of the project.
  • Takes and transcribes dictation, drafts letters and internal memos independently, process, handle, and maintain all types of sensitive information.
  • Coordinates the supporting documentation for the processing of contracts in compliance with company policy and procedures and record all contracts received, under process and finalized.
  • Take responsibility for own ongoing personal development and growth of expertise.
  • Ensure full awareness of work health and safety requirements and expectations in order to minimize health and safety risks for self and colleagues.
  • Consult the Group’s Data Protection Officer in matters related to data protection and privacy as appropriate.
  • Comply with all relevant company policies and procedures regarding the use, processing, disclosure and security of any information (in any form) and ensure that all staff under my direct supervision are aware of and comply.
  • Keep abreast with any market trends and developments.

Qualification

About You:

  • High School Qualification with Minimum 3 years of job-related experience
  • Bachelor’s Degree or Equivalent with Minimum 2 years of job-related experience
  • A graduate preferably with law subjects will be an advantage.
  • Computer Literate with a thorough knowledge of MS Office
  • Experience in a multinational environment preferably in an airline/travel/hotel chain.

Job Specific Skills:

  • Ability to work independently with minimum supervision whilst keeping the Management fully appraised on status.
  • Multi-tasking
  • Strong communications skills (fluent in English language (verbal/writing)
  • Computer Literate with a thorough knowledge of Microsoft Word, Excel, Power Point, and Oracle.
  • Ability to manage office workflow.
  • Time Management
  • Strong Communication Skills
  • Good knowledge of company policies pertaining to Contracts and Agreements.

We are looking for

  • Must be permanently resident in Dubai
  • Must possess adequate professional experience by virtue of having previously carried out similar activities at a high level of responsibility and autonomy.
  • Have at least 5-7 years of relevant experience in the investment fund industry
  • Knowledge of Master- Feeder fund structures
  • University degree, preferably in economics/business, legal, or finance
  • Very strong customer orientation and solution-orientation skills.
  • Very good organizational and communication skills, with an ability to work independently and proactively
  • Excellent team spirit, availability, and flexibility
  • Excellent communication skills, with strong professional English language capability


Your role in the team

Product & Business Support

  • Ensure a great client experience across all funds in line with company standards, procedures and guidelines
  • Work with Service Providers and key internal and external stakeholders to implement, monitor and maintain service level agreements.
  • Act as the first point of escalation for internal and external operational related queries and liaise with Service providers to resolve and report issues in a timely manner
  • Support clients & fund managers on day to by day activities – including but not limited to client queries, Corporate Actions, subscription form template, prospectus, DDQ, RFPs

Shareholders services

  • Oversight of fund administration and custodian teams
  • Liaising with all intermediaries and external agents such as new business introducers, legal advisors, and auditors in respect of team clients
  • Undertake processes related to Feeder Fund set up
  • Feeder fee management including ensuring fee arrangements are appropriate.
  • Rebates oversight
  • Corporate Actions support
  • Orders placement on the Master funds
